What does it cost to register a trademark or a patent in Peru?
Every intellectual property filing has two separate costs: the official fee paid to the State through INDECOPI, and the professional fees of whoever drafts and handles the file. Below are the current official fees, in full, so you know exactly which part of the cost is not negotiable.
Patents and designs
In these three procedures you do not pay the full fee when filing. A percentage is due at the start, and the balance only if the file qualifies for substantive examination.
| Procedure | Due at filing | Total fee |
|---|---|---|
| Invention patent 55% due at filing | S/ 396.00 | S/ 720.00 |
| Utility model 70% due at filing | S/ 226.80 | S/ 324.00 |
| Industrial design 60% due at filing | S/ 216.00 | S/ 360.00 |

Utility model or invention patent: the choice is not always yours
Looking only at the fees, the utility model seems the obvious option: it costs S/ 226.80 against S/ 396.00 and is resolved in half the time. But the figure is not chosen on price. The law defines what each one can protect, and in most cases it is the nature of the invention that decides.
In other words: the utility model protects objects with a shape. And article 82 expressly excludes processes from this figure, along with everything already excluded from invention patentability. That is why a new formula, a compound, a pharmaceutical kit, a process or a complex system can only be protected by an invention patent, meeting its requirements: novelty, inventive step and industrial application.
Filing as a utility model something the law does not admit under that figure does not save money: it ends in refusal. If the application has already been filed and the subject matter allows it, article 83 permits converting it into an invention patent application.

The gap does not mean the utility model is the easy route. It reflects that it is examined for technical advantage rather than inventive step, a requirement that is more attainable to establish. When the invention fits the figure, the path is shorter and cheaper; when it does not fit, the correct figure is the only one that works.
Trademarks and distinctive signs
Applies to product and service marks, collective and certification marks, trade names and slogans. The fee is charged per class of the Nice Classification in which protection is sought.
| Procedure | Standard fee | MYPE fee |
|---|---|---|
| First class | S/ 534.90 | S/ 401.20 |
| Each additional class | S/ 533.30 | S/ 399.90 |

Something few people know
Registering the trademark with INDECOPI is not enough to stop counterfeits at customs. For SUNAT, the Peruvian customs authority, to hold counterfeit goods, the owner must also enrol in its Voluntary Register of Right Holders and renew the enrolment every year, within the first 30 working days. Without it, SUNAT has no one to notify when it detects the copies. How border measures work (in Spanish) →
Copyright and software
This is where most mistakes happen, for two reasons: some procedures share a form but carry different fees, and some registrations cost considerably less through the Online Services Platform (SEL) instead of the filing desk.
| Procedure | Filing desk | SEL platform |
|---|---|---|
| Software or computer programs | S/ 357.70 | Not available |
| Databases, compilations and anthologies Uses the same form as software, but is a different procedure | S/ 177.90 | Not available |
| Literary works | S/ 238.10 | S/ 90.10 |
| Artistic works and works of applied art Painting, photography, sculpture, drawing, engraving, craft, plans and similar | S/ 238.10 | S/ 90.10 |
| Audiovisual works and productions | S/ 238.10 | Not available |
Three things almost nobody tells you
Patenting costs less upfront
Filing an invention patent does not cost S/ 720.00 upfront, but S/ 396.00. The balance is due only if your application reaches substantive examination. Many inventors rule out patenting over a cost they do not actually face at the start.
The right channel saves 62%
Registering a literary or artistic work costs S/ 238.10 at the filing desk, but S/ 90.10 through the SEL platform. Same registration, same legal effect. Note: this difference does not apply to software or trademarks.
MYPEs pay 25% less on trademarks
If your company is registered in REMYPE, with an active RUC in good standing, the trademark fee drops from S/ 534.90 to S/ 401.20. It is worth confirming your registration before filing, not after.
Our fees
Without the overhead of a large firm. Your case is handled directly by the specialist who drafts it — not a team of associates billing by the hour. Closed quote before we start: you know what you will pay before signing anything.
Fees are quoted according to the complexity of each case. Drafting the claims of a biotechnology development is not the same as registering a word mark with no conflicting precedents, and charging the same for both would be dishonest in one direction or the other.
Send us a brief description of your case and you will receive a closed quote, along with a breakdown of the official fees that apply to you. We offer a Non-Disclosure Agreement (NDA) before you share any detail of your invention.
